Terms of Use

These Terms of Use (also serving as the End User License Agreement or "EULA" for the Dinner Date mobile application) govern your access to and use of the Dinner Date app and the dinnerdate.ch website.

2. Acceptance of Terms

By downloading, installing, or using the Dinner Date mobile app (the "App"), or by visiting dinnerdate.ch (the "Site"), you agree to these Terms of Use. If you do not agree, do not use the App or Site.

3. Description of the Service

Dinner Date helps users across Switzerland find venues (such as restaurants, cafés, bars, bakeries, ice cream shops, and similar spots) that are actually open during a chosen date and time window. The App provides real-time hours, interactive maps with adjustable radius, and filters including city (with presets for many locations such as Aarau, Basel, Bern, Biel/Bienne, Chur, Geneva, Lausanne, Lucerne, Lugano, Schaffhausen, St. Gallen, Thun, Winterthur, Zug, Zürich, and others), venue type, cuisine or dietary preference (e.g. Swiss, Italian, French, Vegan, Vegetarian, and many more), and an exact time range.

The App operates on a freemium model: you receive a limited number of free searches per month. Signing in with Google allows the App to track your usage and show your remaining searches. Certain features, such as submitting venue suggestions or feedback (available on the website), and higher or unlimited search allowances, are available only to verified subscribers or lifetime purchasers and may involve signing in with Google or Apple.

While some exploration may be possible without signing in, full use of search tracking, quota visibility, and subscriber features requires authentication via Google or Apple.

4. License Grant (EULA)

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices that you own or control, solely for your personal, non-commercial use.

This license does not include any right to resell, redistribute, or sublicense the App, or to use it in any way not expressly authorized by these Terms.

5. Restrictions

You agree not to:

  • Reverse engineer, decompile, disassemble, or create derivative works from the App;
  • Use the App for any illegal purpose or in violation of any local, national, or international law;
  • Attempt to gain unauthorized access to any part of the App, related systems, or other users' data;
  • Remove, alter, or obscure any proprietary notices in the App;
  • Use the App in a manner that could damage, disable, or impair the service or interfere with others' use.

6. In-App Purchases, Subscriptions, and Search Quotas

The App includes a freemium search model. Users receive a limited number of free searches per month (for example, 10 free searches). Signing in with Google enables the App to track and display your remaining searches for the month. Once the free allowance is exhausted, further searches may require a paid subscription or lifetime purchase.

The App may offer optional premium subscriptions and lifetime access purchases through the Google Play Store and Apple App Store. All billing, payment, renewals, cancellations, and refunds are handled exclusively by Google or Apple according to their respective terms and policies. We do not collect or store your payment information.

Subscriptions typically auto-renew unless you cancel them through your Google or Apple account settings at least 24 hours before the end of the current period. Paid subscriptions or lifetime entitlements typically provide higher or unlimited search allowances as well as access to subscriber-only features (such as venue suggestions on the website).

7. User Submissions and Feedback

If you submit venue suggestions, feature requests, comments, or other feedback through the App, the Site, or associated forms (collectively, "Submissions"), you grant us a perpetual, irrevocable, worldwide, royalty-free, non-exclusive license to use, reproduce, modify, adapt, publish, translate, distribute, and display such Submissions in any media now known or later developed, for the purpose of operating, improving, and promoting the Service.

You represent and warrant that you have all rights necessary to grant this license and that your Submissions do not infringe the rights of any third party. We are under no obligation to use or respond to any Submission.

8. Third-Party Services and Content

The App uses Google Maps API and Google Places (New) API to display maps and place information. Your use of these features is subject to Google's Terms of Service and Privacy Policy, in addition to these Terms.

We are not responsible for the accuracy, availability, or content of any third-party services, links, or data (including venue hours and details provided by Google or venue operators).

9. Intellectual Property

The App, the Site, the Dinner Date name, logos, design, text, graphics, and all other content (excluding third-party content and user Submissions) are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not use our trademarks or branding without our prior written permission.

10. Disclaimers of Warranties

The App and Site are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, or non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or that any venue information, opening hours, or recommendations will be accurate, complete, current, or reliable. Real-world conditions (hours, closures, wait times, etc.) can change at any time. Always verify information directly with the venue before relying on it.

11. Limitation of Liability

To the maximum extent permitted by applicable law, we (and our officers, directors, employees, and agents) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities, arising out of or related to your use of (or inability to use) the App or Site, whether based on warranty, contract, tort (including negligence), or any other legal theory.

Our total aggregate liability to you for any claims arising under these Terms shall not exceed the total amount you paid to us for the App or services in the twelve (12) months preceding the claim (or CHF 50, whichever is greater), if any.

12. Termination

We may suspend or terminate your access to the App or Site at any time, with or without notice, if we reasonably believe you have violated these Terms or for any other reason in our sole discretion.

Upon termination, your license to use the App ends immediately. Sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, governing law, and user submissions) will survive termination.

13. Governing Law and Dispute Resolution

These Terms of Use shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law principles.

Any dispute arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the competent courts in Switzerland.

14. Changes to These Terms

We may update these Terms of Use from time to time. When we do, we will revise the effective date at the top of this page. Your continued use of the App or Site after any changes constitutes your acceptance of the revised Terms.
